Understanding Electric Scooter Legality in Australia: Regulations You Need To Know

Navigating the rules of the road for electric scooters in Australia can seem like a daunting task. However, as the popularity of these nifty personal transport devices continues to skyrocket, it's essential to stay informed about the current legislation to ensure safe and legal riding.

Electric scooters, which fall under the category of Personal Mobility Devices (PMDs), are subject to various laws that can differ significantly from state to state in Australia. Here's what you need to know before you hit the pavement:

New South Wales (NSW): As of my knowledge cutoff in early 2023, electric scooters are only legal to ride on private property. Riding on public roads and footpaths is not permitted.

Victoria: Trial programs are in place, allowing e-scooters to be ridden in certain areas up to a speed of 10 km/h on footpaths and up to 20 km/h on bicycle paths and roads with a speed limit of up to 50 km/h.

Queensland: E-scooters can be used on footpaths, shared paths, and roads with a speed limit of 50 km/h or less. The rider must not exceed 25 km/h and must wear a helmet.

South Australia: Regulations here permit the use of e-scooters on footpaths and shared paths, but not on roads with certain exceptions such as crossings.

Western Australia: Riders aged 16 and over can use e-scooters up to a maximum speed of 10 km/h on footpaths and up to 25 km/h on shared paths and bicycle lanes.

Tasmania and Northern Territory: While there are no specific laws regarding e-scooters, they are generally treated like bicycles, requiring riders to adhere to bicycle laws.

Australian Capital Territory (ACT): E-scooters are allowed on footpaths and shared paths but not on roads, except for crossing.

It's critical to wear a helmet, follow road rules, and keep your e-scooter's speed under control. Modification of e-scooters to increase their speed beyond the legal limits is strictly prohibited.
