Electric Scooters Classification in New Jersey

Electric scooters have become a popular mode of transportation in recent years, providing an efficient, cost-effective, and environmentally friendly way to navigate urban areas. If you live in New Jersey and you are considering using an electric scooter as your preferred means of transportation, it's essential to understand how they are classified in the state. New Jersey has specific laws that apply to electric scooters and their usage, which must be adhered to in order to operate them legally.

In New Jersey, electric scooters are classified as motorized or electric bicycles, defined by New Jersey Statute 39:1-1. As per this classification, electric scooters must adhere to the following requirements:

  1. It must be equipped with a motor that does not exceed 750 watts (1 horsepower).
  2. It must not be capable of speeds greater than 20 miles per hour on level ground.
  3. It must have functioning pedals for human-propelled propulsion.
  4. The operator must be at least 15 years old and have a valid driver's license, provisional license, or a motorized bicycle (moped) license.

There are different classes of electric scooters, but New Jersey does not distinguish between the classes. Instead, the state focuses on the general requirements mentioned above.

When it comes to operating electric scooters on public roads, New Jersey law stipulates that these vehicles must follow the same rules as traditional bicycles. This means that electric scooters must be ridden in designated bicycle lanes or as close to the right-hand curb as possible. Furthermore, they are not allowed on sidewalks or pedestrian pathways unless specifically authorized by local ordinance.

Helmet use is also essential. In New Jersey, electric scooter riders under the age of 17 are required to wear an approved bicycle helmet when riding on public roads, bike paths, or public property.

It's crucial to keep in mind that each town or city in New Jersey may have its own additional laws and regulations concerning electric scooters, so make sure to familiarize yourself with any specific rules in your area.

In summary, electric scooters in New Jersey are classified as motorized or electric bicycles, with specific requirements and laws governing their usage. By following these regulations and adhering to local ordinances, you can safely and legally enjoy the benefits that electric scooters offer as an efficient and environmentally friendly mode of transportation.
